Lewis Johs’s Guardianship Practice represents families, individuals, entities, fiduciaries, and alleged incapacitated persons throughout New York in matters involving the care and protection of vulnerable adults. When a person is unable to manage their personal or financial affairs due to illness, disability, or cognitive decline, the court may appoint a guardian to act on their behalf under Article 81 of the Mental Hygiene Law or Article 17-A of the Surrogate Court.

Our attorneys understand the sensitive nature and high stakes of guardianship matters and appear regularly in Supreme Court and Surrogate’s Court throughout the state. We handle petitions for the appointment of guardians, contested proceedings, emergency applications where immediate action is required, and disputes involving powers of attorney and health care proxies. We also represent alleged incapacitated persons who oppose the appointment of a guardian, including advocating for less-restrictive alternatives. We counsel guardians on their fiduciary obligations, including compliance with court orders and the preparation and filing of annual and final accountings. In addition, we represent clients in removal of fiduciary proceedings, including those commenced under Article 5 of the General Obligations Law.
