Attorneys John Saville and Joshua Sprague Summary Judgment

Attorneys John Saville and Joshua Sprague recently obtained summary judgment in a Child Victims Act case on behalf of a Long Island public school district.  In that case, venued in Suffolk County Supreme Court, plaintiff alleged that in 1970-1971, while a student in the district, he was sexually abused by his teacher.  In dismissing the negligence claims against the school district, the Court agreed with John and Joshua’s argument that the developed record established that the school district did not have actual or constructive knowledge of the former teacher having a propensity for sexual misconduct.  The absence of that actual or constructive knowledge — the seminal element of any claim seeking to hold a school district liable for negligence based upon the intentional sexual misconduct of one of its employees – resulted in the Court granting our motion.
