Partner Robert Yenchman Obtains Summary Judgment

Partner Robert Yenchman successfully moved for summary judgment in an action venued in Suffolk County. In this labor law case, the plaintiff brought suit to recover damages for injuries he sustained when a scaffold that he was using tilted over, causing him to fall. Our client was a site safety consultant on the project. After discovery, Rob moved for summary judgment. The Court held that our client did not create the defect that caused the scaffold to tilt, and he did not have authority to direct, supervise, and control the work giving rise to plaintiff’s injury. Moreover, the Court held that there is no reading of the contractual agreement between our client and the property owner that would result in a finding that the plaintiff’s accident arose out of our client’s work.
