Kevin Mescall concentrates his practice in the litigation, trial and mediation of significant bodily injury and property damage claims involving products liability, construction site accidents, New York State Labor Law absolute liability matters, toxic torts, mass torts, security, construction defects, wrongful death, lead poisoning, professional indemnity and municipal liability. He is also actively engaged in complex insurance coverage disputes and first party property claims. He has served as lead counsel to several contractors sued by thousands of clean-up workers alleging respiratory injuries sustained in the aftermath of the 9/11 terrorist attack of the World Trade Center. He has also served as National Coordinating Liability Counsel for a major international insurance company in the defense of products liability claims involving thousands of individual claimants as well as class actions consolidated in Federal Multi District Litigation. His clients include members of the Lloyd’s Insurance Market, domestic insurers and Fortune 100 corporations.
Kevin is admitted to practice in the State of New York as well as the U.S. District Courts for the Eastern and Southern Districts of New York. In addition to his litigation practice, Kevin also serves as an arbitrator and mediator in commercial, general liability and insurance coverage disputes. He has served as an arbitrator on the legal panel of the New York Stock Exchange. He currently serves on the Executive Board of the Defense Research Institute International Committee and is a member of the American Bar Association, the New York State Bar Association, the Claims and Litigation Management Alliance and the International Society of Primerus Law Firms. He has made presentations in London for the London Insurance Market at Lloyd’s and Xchanging and has also lectured for the New York State Bar Association, the New York State Trial Lawyers Association, DANY, DRI and the Crittenden Medical/Legal Conference. He is an adjunct professor at Pace University and Suffolk County Community College. Kevin participated in a secondment program with Xchanging Claims Services in London where he obtained extensive experience in complex claims handling for the London Insurance Market.
Kevin was awarded a Juris Doctor degree from St. John’s University School of Law in 1982 where he was also a member of the Moot Court Senior Board. He obtained a Bachelor of Arts degree from the University of Notre Dame in 1979 where he was also a member of the University Judicial Council. Kevin also attended the Executive Management Training Program offered by The Wharton School of Business of the University of Pennsylvania.
