Summary Judgment Granted for Partner David Metzger

Partner David Metzger successfully moved for summary judgment on behalf of a Manhattan townhouse owner in a case involving a slip and fall on ice on stairs which led from the sidewalk down to a commercial tenant’s space. David established that the tenant, pursuant to the terms of the lease, was responsible for the maintenance and ice/snow removal of those stairs and that the owner of the townhouse, who neither lived at the premises nor regularly inspected the premises, was an “out of possession landlord.” The New York County Supreme Court Judge held that the parties failed to overcome this prima facie showing and dismissed the plaintiff’s case and enforced our client’s cross claims against the tenant.
