Partner Karen Berberich and Associate Amanda Dickens Obtain Summary Judgment
Karen Berberich and Amanda Dickens recently won summary judgment action in a declaratory judgment action between two insurance companies. The action was brought by the insured’s general liability carrier against the personal auto insurance carrier to determine which carrier owed bodily injury liability coverage for injuries allegedly sustained when a dry-cleaning press fell from the trailer being used to transport it. Karen and Amanda successfully argued that because the trailer was unhitched from the insured vehicle prior to the accident, the injuries did not arise out of use or operation of an insured auto and that the general liability carrier was obligated to provide coverage for the defense and indemnification of the insured in the underlying action.
