Lewis Johs attorneys Amy Pincus and Joseph Giglio recently obtained summary judgment on behalf of our client, a plumbing contractor, in a negligence lawsuit brought in Supreme Court, Queens County. The plaintiff tripped and fell in a roadway while crossing the street. Amy and Joe successfully argued that our client performed repair work two years prior to the accident and a half block away from the alleged accident site. Our client had passed inspections for the work they performed and did not have notice of any defect in their repair. Therefore, the Court found that our client did not have any constructive notice or actual notice of the alleged defect, which consequently negated any duty it may have had to the plaintiff.
