Partner Karen Berberich and Senior Associate Amanda Dickens obtained summary judgment in a Putnam County declaratory judgment action on behalf of an insurance carrier seeking a declaration that it had no duty to defend and indemnify its insured who was being sued by his adult daughter, who was living in his home, for injuries she sustained in a slip and fall at the property. Karen and Amanda argued successfully that coverage was barred by an exclusion in the policy for injuries sustained by an insured person because the plaintiff and defendants resided in the same household at the time of the incident. The Court agreed that plaintiff resided in the defendant’s household, upholding the disclaimer and relieving the insurance carrier of its coverage obligations.
