Partner Megan Murphy Obtains Summary Judgment
Megan Murphy recently secured dismissal, via summary judgment, on behalf of our client in a motor vehicle action venued in Kings County Supreme Court. In this case arising from a three-vehicle collision, plaintiff alleged that he sustained serious and permanent injuries including those to his head, lower back, and neck. He also claimed emotional damage, including anxiety. Ms. Murphy argued that plaintiff failed to satisfy the “serious injury” threshold set forth in New York State Insurance Law Section 5102(d). In support of her motion, Ms. Murphy submitted expert reports prepared by an orthopedist and neurologist, each finding that plaintiff demonstrated no symptoms of traumatic injuries to his affected body parts. Plaintiff failed to submit any evidence to rebut Ms. Murphy’s arguments. The Court dismissed plaintiff’s Complaint in its entirety as to our client.
