Summary Judgment and Dismissal Obtained by Adam Silverstone

Adam Silverstone obtained summary judgment and dismissal of a third-party complaint on behalf of our client, a school bus transportation company, in a personal injury matter pending in Supreme Court, Suffolk County.

The action stemmed from an alleged motor vehicle accident involving the client’s school bus. Adam successfully demonstrated that the client was not a proper third-party defendant under New York State Workers’ Compensation Law and was immune from claims for indemnification and contribution. He further established that none of the plaintiff’s alleged injuries constituted a “grave injury” as defined under Section 11 of the statute. The Court agreed and granted summary judgment, dismissing the defendants’ third-party complaint.
