Dismissal Obtained by Caroline K. Hock

Posted: July 7, 2026

Caroline K. Hock secured a dismissal in Supreme Court, Queens County, on behalf of multiple clients, including a globally known transportation services provider, a national trucking company, and a regional retail company.  This personal injury action stemmed from an alleged motor vehicle accident involving our clients’ truck.  Caroline argued successfully that (1) plaintiff’s action was time-barred pursuant to the relevant statute of limitations, (2) plaintiff did not timely or properly file her amended complaint, and (3) that one of our clients was not a proper party to the action and is immune from vicarious liability pursuant to the Graves Amendment.  While plaintiff argued that her amended complaint should be heard by the court, the court rejected that argument as unsupported by the evidentiary record.  The case was dismissed against all clients.
