Rebecca K. Devlin Obtains Summary Judgment

Partner Rebecca K. Devlin secured summary judgment in Supreme Court, Nassau County on liability, winning dismissal of the Complaint and all cross claims against our client, the owner of a rental vehicle.  Rebecca successfully demonstrated that our client was not a proper party and is immune from vicarious liability under the Graves Amendment.

The plaintiff argued the motion was premature due to outstanding discovery, citing possible mechanical defects or criminal wrongdoing. The Court rejected those claims, finding Rebecca met her burden by showing the vehicle was properly maintained and that no negligence or wrongdoing by our client contributed to the accident.
