Associate Sean Brodersen successfully moved for summary judgment in a medical malpractice case venued in Queens County.  In this case, the plaintiff sued to recover damages allegedly sustained when the defendants failed to timely remove an infected leg graft, resulting in the need for an above-the-knee amputation.  We represented a hospital where the plaintiff received treatment for his leg graft and ultimately underwent the amputation.  Sean argued that our client’s staff did not deviate from the applicable standard of care in treating the plaintiff, and that our client could not be held vicariously liable for the acts or omissions of the co-defendant private attending physicians.  The Court agreed and dismissed all claims, both direct and vicarious, as to our client.
