Summary Judgment Obtained by Ross Ruggiero

Lewis Johs partner Ross Ruggiero obtained a dismissal via motion for summary judgment in a trip and fall case venued in Bronx County Supreme Court.  In this case, plaintiff alleged a trip and fall on a sidewalk adjacent to our client’s home, a two-family residence.  Ross argued that New York Administrative Code Section 7-210(b) exempts two-family residential properties from liability where the property owners abutting the sidewalk did not cause or create the alleged defect on the sidewalk.  Ross also established that the alleged incident took place on our client’s neighbor’s side of the property line and not on our client’s property.  The Court agreed with Ross’s arguments and dismissed all claims against our client.
