Partner Teri Scotto-Lavino Obtains Summary Judgment

Teri Scotto-Lavino secured summary judgment on liability for our client, an OB/GYN, in a medical malpractice matter venued in Kings County Supreme Court.  At the conclusion of an otherwise benign pregnancy, plaintiff became pre-eclamptic and was admitted to the hospital.  After days in the hospital, our doctor assumed care and, soon after, delivered the baby by cesarean section.  Following the delivery, plaintiff began to hemorrhage.  Plaintiff claimed that the doctor failed to render all medically necessary treatment to control the post-delivery hemorrhage prior to the performance of a hysterectomy.  Plaintiff claims that those failures rendered plaintiff unable to bear additional children.  In granting summary judgment, the Court agreed that the doctor treated plaintiff with all reasonable care, performed all necessary procedures and rendered all necessary treatment prior to the performance of the hysterectomy necessary to stop the hemorrhage, saving the life of both the plaintiff and the baby she delivered.
