Partner Rebecca Devlin Obtains Summary Judgment

Partner Rebecca Devlin secured summary judgment on liability for our client in a complex three-vehicle collision case venued in Suffolk County Supreme Court. The Court ruled that Rebecca’s client bore no responsibility for the accident, finding that he was confronted with a sudden emergency when he struck the rear of the plaintiff’s vehicle. Prior to the impact, the plaintiff’s vehicle, traveling northbound ahead of our client’s vehicle, had been involved in a collision with the co-defendant’s vehicle. Co-defendant’s vehicle, traveling southbound, allegedly lost control due to poor weather conditions and veered into the northbound lanes. The Court agreed with Rebecca’s argument that the co-defendant driver had a duty to operate his vehicle with reasonable care, taking into account the actual and potential driving hazards posed by the foggy and rainy weather, and held that co-defendant’s actions were the sole proximate cause of the accident.
