Associate Adam Silverstone Obtains Summary Judgment for Security Guard Company

Associate Adam Silverstone moved successfully for summary judgment in a negligent security action venued in Suffolk County Supreme Court. In this case, the plaintiff sued to recover damages for life-threatening injuries she sustained as the result of a vicious assault by a co-defendant while plaintiff was a guest at a local motel. The co-defendant motel owner sought indemnification and contribution from Adam’s client, a security guard company. Adam argued that the evidence submitted demonstrated that our client was required to provide only limited supplemental security services for the motel at certain dates and times, and did so properly. The Court agreed, holding that our client did not owe a duty of care to plaintiff as our client was not obligated to provide security services to the motel during the time period in which the assault occurred.
