Karen Berberich and Amanda Dickens Obtain Summary Judgment for Insurance Carrier
Karen Berberich and Amanda Dickens obtained summary judgment dismissal of an action brought by an insured homeowner against an insurance carrier client. The Washington County Supreme Court lawsuit had sought coverage for the remediation of an oil spill in the plaintiff’s home. Karen and Amanda successfully argued that the pollution exclusions applied to bar coverage under both the first-party and liability sections of the client carrier’s policy. Using the Court’s dismissal order in that case, Karen and Amanda then convinced the State of New York to discontinue the state’s separate action against the insurance carrier for remediation of the oil spill. Karen and Amanda argued that the same exclusions also applied to bar coverage for the State of New York’s claim.
