June 2010.  Lewis Johs Attorney Teri Scotto-Lavino prevailed on a motion for summary judgment in Richmond County, Supreme Court.  This matter involved a claim for negligence against Lewis Johs' client, an internist, who treated the plaintiff just prior to her pregnancy.  The plaintiff alleged that Lewis Johs' client failed to properly monitor and manage her diabetes and seizure disorder prior to her pregnancy, which caused severe deformities to her infant.  Ms. Scotto-Lavino moved for summary judgment on the grounds that plaintiff refused to cooperate with the doctor's prescribed managed care regime.  The Court agreed with Ms. Scotto-Lavino and granted summary judgment stating, "[T]he record is clear that [plaintiff] completely disregarded the advice of medical professionals and did not take responsibility for her own health, which had dire consequences for her child."
