March 2010.  Lewis Johs senior attorney Edward G. Lukoski obtained another defense verdict following a trial in Supreme Court, New York County on behalf of Lewis Johs's client, the Long Island Rail Road.  Plaintiff, a 53 year-old female, claimed she fell due to the excessive gap at the Long Island Rail Road Merillon Avenue station in April 2006.  Plaintiff suffered a comminuted fracture of her left patella, necessitating excision and tendon reconstruction.  Plaintiff's treating orthopedist testified during trial that she would need a knee replacement in the future.  The plaintiff demanded $180,000 and the jury returned a defendant’s verdict.
