Defendants' Verdict for Debbie Aviles in Medical Malpractice Case  

November 2009. Lewis Johs partner, Debbie Aviles, obtained a defendants' verdict for her clients in Supreme Court, Suffolk County. The case involved a claim that several doctors failed to diagnose subluxation (dislocation) of the neck in a seven-year old girl who had been in a car accident. Although the plaintiff was in the hospital for four days, she had no complaints of neck pain until she was released. Two days after she was released from the hospital she went to see Ms. Aviles' clients for neck pain. She saw several doctors over the next month but it wasn't until 6 weeks after the accident that the subluxation was diagnosed. The defendants' position was that the tests taken during the plaintiff's four days in the hospital did not suggest subluxation. The jury awarded a defendants' verdict to all Lewis Johs' client defendants.  The jury ruled against the non-Lewis Johs client doctor for past pain and suffering. There was no award for future pain and suffering.
