Erika A. Bordan Successful in Obtaining Summary Judgment 

Erika A. Bordan successfully argued and was granted summary judgment in a case wherein Lewis Johs' client allegedly fractured the right tibial sesamoid bone of the plaintiff, while performing physical therapy for bilateral fascitis.  Lewis Johs retained a radiologist, who reviewed the x-rays taken right after the incident and found no evidence of a fracture.  The radiologist reviewed x-rays taken three months later and found no evidence of callous formation, which would normally appear in a healing fracture.  In addition, the physical medicine physician found that Lewis Johs’ client did not deviate in the treatment plan or modalities utilized.
 
The plaintiff argued that the fracture was caused by defendant's treatment and that the question of the extent of the injury was one of damages and not of liability.  Judge Randolph Jackson in Supreme Kings outright granted Lewis Johs’ summary judgment motion.
