Defendant's Verdict for Sean Rooney in Cardiological Medical Malpractice Case Involving Claims of Brain Injury
October 2009. Lewis Johs partner, F. Sean Rooney, obtained a defendant's verdict for his client, a cardiologist, in a 4 week trial held in Supreme Court, Suffolk County before Judge Thomas Whelan. The case involved a claim that the plaintiff-patient was discharged following a hospitalization for leg wounds and newly diagnosed atrial fibrillation without proper instructions for the use and periodic testing needed for Coumadin, an oral anti-coagulant (blood thinner). The plaintiff claimed that an intracranial hemorrhage occurred as a result of overdosage of Coumadin which resulted in brain damage and psychiatric injuries. The jury found that proper instructions were given to the plaintiff and the defendants did not depart from accepted standards of practice.
