October 2010.  Partner Michael G. Kruzynski and Associate Seth M. Weinberg successfully appeal the Queens County, Supreme Court's judgment against Lewis Johs' client, the Long Island Rail Road ("LIRR").  The Court found the LIRR liable for plaintiff's fall in the space between a train and the station platform.  At trial, plaintiff admitted she knew about the space and failed to look where she was walking.

The Appellate Division, Second Department, reversed the judgment against the LIRR in the principal sum of $175,000.  The Appellate Division granted Lewis Johs' motion to set aside the jury verdict on the issue of liability and excessive damages, and for a new trial.
