Defendant's Verdict for Lewis Johs Senior Attorney Edward G. Lukoski in Serious Train Accident Trial

February 2010.  Lewis Johs senior attorney Edward G. Lukoski obtained a defense verdict following a trial in Supreme Court, Queens County.  Plaintiff, a fifty-year old epileptic, suffered a seizure and fell onto the train tracks between the running rails at the East New York station in Brooklyn.  An eastbound train struck the plaintiff, severing his left arm above the elbow and his left leg below the knee.  The engineer, conductor, and brakeman did not see the plaintiff.  At trial, plaintiff produced a video taken from the front of the train and used an expert engineer to opine that it was possible to see someone on the tracks at least 1,000 feet away.  The plaintiff demanded $6 million, the judge recommended $3.5 million and the jury returned a defendant’s verdict in approximately an hour.
